Functions of the Agency
The functions and competencies of the National Agency for Cannabis Control in supervision, control and institutional cooperation, in accordance with the applicable law.
Supervision of Licensed Activities
The Agency supervises licensed and authorised activities at every stage and during every production cycle to ensure that the activity: a. Is carried out in accordance with the legal provisions and by-laws, the conditions specified in the licence or permit, as well as the approved production plan. b. Is not carried out contrary to the objectives of the Law and the international obligations of the Republic of Albania.
Controls and Inspections
The Agency carries out supervision, controls and inspections in accordance with this Law and, where necessary, coordinates the process in cooperation with other institutions.
Exchange of Information with Judicial Authorities
In the performance of its duties, the Agency exchanges information with the General Jurisdiction Prosecution Offices, the Special Prosecution Office / National Bureau of Investigation, the State Police, as well as other competent authorities, and may conclude bilateral or multilateral cooperation agreements with them.
Verifications and Proposals for Measures
The Agency, either on its own initiative or upon request, carries out verifications in accordance with this Law. Where the imposition of measures for the suspension or revocation of a licence is deemed necessary, the matter shall be referred to the Licensing Commission for review.
International Cooperation
The Agency cooperates and exchanges information with the State Police and other national or international institutions with which the Republic of Albania has concluded agreements in the field of combating the use and trafficking of narcotic drugs and psychotropic substances, as well as combating the laundering of proceeds from illegal activities.
Data Administration
The Agency collects and administers the data necessary for the performance of its functions concerning licensed and authorised activities, as well as the holder of the licence or permit. Primary and secondary data shall be determined by a decision of the Council of Ministers.
Six-Month Reporting
The Agency submits a six-month work report to the Ministry responsible for Health, which is also communicated to the Ministry responsible for Public Order and Security.
Other Functions and Internal Organisation
The Agency performs any other function provided for by law or by its internal rules of operation. The rules governing the Agency's internal organisation shall be approved by the minister responsible for health.
Regulations of Licensed Entities
The Agency approves the operating regulations of licensed entities.

Licensing Commission
The Commission is established within the Agency and is responsible for reviewing and evaluating applications for obtaining a license for cannabis cultivation.
A Licensing Commission is established within the Agency for the review and evaluation of applications submitted for obtaining a license for cannabis cultivation.
The Commission consists of 7 members, composed as follows:
3 representatives from the ministry responsible for health;

2 representatives from the ministry responsible for agriculture;
1 representative from the ministry responsible for the economy.
The Chairperson of the Commission shall be one of the representatives of the ministry responsible for health.
The members of the Commission shall be appointed for a term of up to 4 years.
The members of the Commission are required to sign a confidentiality declaration and a declaration of the absence of a conflict of interest, and shall also hold a security clearance certificate issued by the National Authority for the Security of Classified Information.
Responsibilities of Commission

Administers and verifies the documentation submitted by entities applying to obtain a license.

Assesses compliance with the requirements relating to the premises, equipment and personnel for obtaining a license.

Prepares the list and the relevant report concerning the applicant entities, and prepares the proposal for granting or refusing the license.

Where violations are identified, proposes to the Minister responsible for health the imposition of the administrative measure of suspension or revocation of the license.
