Licensing<\/h1>\n

PROCEDURE FOR OBTAINING A LICENSE FOR ACTIVITIES RELATED TO THE PRODUCTION OF CANNABIS FOR MEDICAL PURPOSES<\/p>\n

A license for the production of cannabis for medical purposes may include the following activities:<\/p>\n

    \n
  1. a) Cultivation, production of cannabis plants for medical purposes<\/li>\n
  2. b) Transport of seeds, plants, and cannabis products and by-products for medical purposes within the territory of the Republic of Albania;<\/li>\n
  3. c) Export of cannabis plants, products, and by-products for medical purposes.<\/li>\n<\/ol>\n

    The license is granted for one or more activities, for a period of 15 years, with the right of renewal upon request, for each activity and based on the selection procedure organized by the Agency. The format of the license for activities related to cannabis production for medical purposes is approved by order of the Minister responsible for health.<\/p>\n

    The license is granted only to the entity that meets the conditions and criteria specified in this law, and only for the units and activities specified in its cultivation plan, specifying the coordinates of the unit’s location and the entity’s relationship with the land.<\/p>\n

    The license is granted only in the name of the entity and is non-transferable and irrevocable. The license includes the activities for which the entity is licensed, fulfilling the requirements specified in this law.<\/p>\n

    If the license specifies that certain activities, as stipulated in the license, may be performed entirely or partially by other entities, these entities shall be verified regarding the integrity requirement and explicitly specified in the license. Changes related to the transfer of ownership of these entities require prior written approval from the Licensing Commission. The Commission grants or denies preliminary approval within 3 months from the complete submission of the request, supported by documentation specified for verifying integrity.<\/p>\n

    The license specifies one or more units for which the entity has met the criteria. If the entity is licensed for more than one unit, they must be contiguous to each other and, in any case, not more than 4 units under the same license.<\/p>\n

    The cultivation activity license is granted only on open surfaces, covered or in greenhouses. The surface area of the licensed unit for cannabis cultivation for medical purposes shall not be less than 5 hectares and not more than 10 hectares.<\/p>\n

    The total permissible area for the cultivation of cannabis plants for medical purposes shall not exceed 200 hectares nationwide.<\/p>\n

    The applicant, to obtain a license, pays a fee of 100,000 (one hundred thousand) lek at the time of submitting the application, which is non-refundable. The procedure for paying the fee and the use of this fee is determined by joint guidance from the Minister responsible for finance and the Minister responsible for health.<\/p>\n

    The license terms, as specified in paragraph 2 of Article 15, must be adhered to by the licensed entity throughout its validity period. Every 3 years, the license terms are reassessed by the Agency, which, if it finds non-compliance with the conditions and criteria, proposes, as appropriate, the suspension or revocation of the license or requests the entity to fulfill the conditions within a 30-day period.<\/p>\n

    No later than 6 months before the expiration of the license validity period, the entity may request its renewal when it proves that it meets the licensing conditions according to the provisions of this law.<\/p>\n

    1. Licenca p\u00ebr prodhimin e cannabis-it p\u00ebr q\u00ebllime mjek\u00ebsore mund t\u00eb p\u00ebrmbaj\u00eb veprimtarit\u00eb e m\u00ebposhtme:\r\n
        \r\n
      1. a) kultivimin, prodhimin e bim\u00ebs s\u00eb cannabis-it p\u00ebr q\u00ebllime mjek\u00ebsore<\/li>\r\n
      2. b) transportimin e far\u00ebrave, bim\u00ebve dhe produkteve e n\u00ebnprodukteve t\u00eb cannabis-it p\u00ebr q\u00ebllime mjek\u00ebsore n\u00eb territorin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb;<\/li>\r\n
      3. c) eksportin e bim\u00ebve, produkteve dhe n\u00ebnprodukteve t\u00eb cannabis-it p\u00ebr q\u00ebllime mjek\u00ebsore.<\/li>\r\n<\/ol>\r\n<\/li>\r\n
      4. Licenca jepet p\u00ebr nj\u00eb ose disa veprimtari, p\u00ebr nj\u00eb periudh\u00eb 15-vje\u00e7are, me t\u00eb drejt\u00eb rinovimi me k\u00ebrkes\u00eb, p\u00ebr secilin nga aktivitetet dhe bazuar n\u00eb procedur\u00ebn p\u00ebrzgjedh\u00ebse t\u00eb organizuar nga Agjencia. Formati i licenc\u00ebs p\u00ebr ushtrimin e aktiviteteve t\u00eb lidhura me prodhimin e cannabis-it p\u00ebr q\u00ebllime mjek\u00ebsore miratohet me urdh\u00ebr t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr sh\u00ebndet\u00ebsin\u00eb.<\/li>\r\n
      5. Licenca i jepet vet\u00ebm subjektit q\u00eb plot\u00ebson kushtet dhe kriteret e p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb ligj, si dhe vet\u00ebm p\u00ebr nj\u00ebsit\u00eb dhe aktivitetin e k\u00ebrkuar e t\u00eb p\u00ebrcaktuar n\u00eb planzhvillimin e saj, duke p\u00ebrcaktuar koordinatat e vendndodhjes s\u00eb nj\u00ebsive dhe marr\u00ebdh\u00ebnien e subjektit me tok\u00ebn.<\/li>\r\n
      6. Licenca jepet vet\u00ebm n\u00eb em\u00ebr t\u00eb subjektit dhe \u00ebsht\u00eb e patransferueshme dhe e patjet\u00ebrsueshme. Licenca ka si pjes\u00eb p\u00ebrb\u00ebr\u00ebse t\u00eb saj aktivitetet p\u00ebr t\u00eb cilat subjekti licencohet, me plot\u00ebsimin e k\u00ebrkesave t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb ligj.<\/li>\r\n
      7. N\u00ebse n\u00eb licenc\u00eb \u00ebsht\u00eb p\u00ebrcaktuar se aktivitete t\u00eb caktuara, t\u00eb parashikuara n\u00eb licenc\u00eb, mund t\u00eb kryhen t\u00ebr\u00ebsisht apo pjes\u00ebrisht nga subjekte t\u00eb tjera, k\u00ebto subjekte do t\u00eb verifikohen n\u00eb lidhje me plot\u00ebsimin e kushtit t\u00eb past\u00ebrtis\u00eb s\u00eb figur\u00ebs, si dhe p\u00ebrcaktohen shprehimisht n\u00eb licenc\u00eb. Ndryshimet q\u00eb lidhen me tjet\u00ebrsimin e pron\u00ebsis\u00eb s\u00eb k\u00ebtyre subjekteve k\u00ebrkojn\u00eb miratimin paraprak me shkrim t\u00eb Komisionit t\u00eb Licencimit. Komisioni jep ose refuzon miratimin paraprak, brenda 3 muajve nga paraqitja e plot\u00eb e k\u00ebrkes\u00ebs, mb\u00ebshtetur n\u00eb dokumentacionin e p\u00ebrcaktuar n\u00eb lidhje me verifikimin e past\u00ebrtis\u00eb s\u00eb figur\u00ebs.<\/li>\r\n
      8. Licenca p\u00ebrcakton nj\u00eb ose disa nj\u00ebsi p\u00ebr t\u00eb cilat subjekti ka plot\u00ebsuar kriteret. N\u00ebse subjekti licencohet p\u00ebr m\u00eb shum\u00eb se nj\u00eb nj\u00ebsi, ato duhet t\u00eb jen\u00eb kufitare me nj\u00ebra-tjetr\u00ebn dhe, n\u00eb \u00e7do rast, jo m\u00eb shum\u00eb se 4 nj\u00ebsi n\u00eb t\u00eb nj\u00ebjt\u00ebn licenc\u00eb.<\/li>\r\n
      9. Licenca p\u00ebr aktivitetin e kultivimit jepet vet\u00ebm n\u00eb sip\u00ebrfaqe t\u00eb hapura, t\u00eb mbuluara ose sera. Sip\u00ebrfaqja e nj\u00ebsis\u00eb s\u00eb licenc\u00ebs t\u00eb aktivitetit p\u00ebr kultivim t\u00eb cannabis-it p\u00ebr q\u00ebllime mjek\u00ebsore nuk mund t\u00eb jet\u00eb m\u00eb e vog\u00ebl se 5 hektar\u00eb dhe jo m\u00eb e madhe se 10 hektar\u00eb<\/li>\r\n
      10. Sip\u00ebrfaqja totale e lejuar p\u00ebr kultivimin e bim\u00ebs s\u00eb cannabis-it p\u00ebr q\u00ebllime mjek\u00ebsore nuk mund t\u00eb jet\u00eb m\u00eb e madhe se 200 hektar\u00eb n\u00eb rang komb\u00ebtar.<\/li>\r\n
      11. K\u00ebrkuesi, p\u00ebr t\u2019u pajisur me licenc\u00eb, paguan n\u00eb momentin e paraqitjes s\u00eb k\u00ebrkes\u00ebs nj\u00eb tarif\u00eb n\u00eb vler\u00ebn 100 000 (nj\u00ebqind mij\u00eb) lek\u00eb, e cila \u00ebsht\u00eb e pakthyeshme. Procedura e pagimit t\u00eb tarif\u00ebs dhe m\u00ebnyra e p\u00ebrdorimit t\u00eb k\u00ebsaj tarife p\u00ebrcaktohen me udh\u00ebzim t\u00eb p\u00ebrbashk\u00ebt t\u00eb ministrit p\u00ebrgjegj\u00ebs p\u00ebr financat dhe ministrit p\u00ebrgjegj\u00ebs p\u00ebr sh\u00ebndet\u00ebsin\u00eb.<\/li>\r\n
      12.
